THE CANADA DRY* REAL MODERN FAMILY / LES VRAIS PARENT CONTEST

INTERNET ACCESS, PIN, VALID EMAIL ACCOUNT OR A FACEBOOK ACCOUNT ARE NECESSARY IN ORDER TO PARTICIPATE.



1. CONTEST PERIOD

The Canada Dry* REAL MODERN FAMILY / LES VRAIS PARENT CONTEST (the "Contest" or "contest") commences September 2, 2014 at 12:00:00 pm ET and ends December 1, 2014 at 11:59:59 am ET (the "Contest Period"). This contest is brought to you by Canada Dry Mott's Inc. (the "Contest Sponsor"). The Contest computer system (the “Contest Computer”) is used to govern all computer and time-related aspects of the Contest and, among other things, is the official time-keeping device for the Contest. 

2. ELIGIBILITY

NO PURCHASE NECESSARY. The contest is open to legal residents of Canada who are age of majority or older in their respective Province or Territory of residence.

Notwithstanding the above, this contest is not open to employees, representatives, agents, officers or directors (or those with whom such persons are domiciled, whether related or not) of: (i) the Contest Sponsor, its divisions, subsidiaries, affiliates and bottlers; (ii) participating foodservice/on premise/convenience locations; and (iii) Contest Sponsor’s advertising and promotional agencies, contest suppliers, prize suppliers, redemption/recycling centres and any other entity involved in the development, production, implementation, administration, judging or fulfillment of the Contest (collectively, the “Contest Parties”).

3. HOW TO ENTER

(a) TO OBTAIN A PIN WITH RETAIL PURCHASE: During the Contest Period, obtain your unique Personal Identification Number ("PIN"), while supplies last, imprinted under the cap of specially-marked bottles and inside specially-marked cartons of the following products (the "Participating Product(s)"):

591 ml, 1 Litre, 2 Litre, and 12 x 355 ml Canada Dry Ginger Ale

2 Litre and 12 x 355 ml Canada Dry Diet Ginger Ale

12 x 355 ml Canada Dry Tonic Water

2 Litre and 12 x 355 ml Canada Dry Club Soda

591 ml, 2 Litre and 12 x 355 ml C'plus* Orange Burst*

591 ml and 12 x 355 ml Canada Dry Green Tea Ginger Ale

Not all Participating Products are available in all regions.

(b) TO OBTAIN A PIN WITH PURCHASE AT FOODSERVICE:  When you purchase a Canada Dry ginger ale with your meal order at participating foodservice/on-premise retail locations across Canada, you will receive one (1) PIN for contest entry, while supplies last. 

(c) NO PURCHASE ENTRY: To obtain one (1) PIN, while supplies last, without making a purchase, clearly print your first and last name, complete mailing address, daytime telephone number and date of birth on a plain piece of paper (not exceeding 8.5” by 11”) and mail it (in an envelope with sufficient postage) along with: (i) a handwritten, original (as defined below) one hundred (100) word essay telling us “what makes your family  real and genuine?”; and (ii) a self-addressed pre-paid stamped envelope with sufficient return postage to: Canada Dry NPN Request, P.O. Box 9410, Toronto, ON M3C 4C6 (each, a “Request”). For a Request to be considered valid, the associated essay must be unique, original to the entrant, handwritten and not previously submitted with any prior Request(s) by such entrant during the Contest Period. In the case of multiple Requests in the same envelope and/or duplicate essays in subsequent Requests (all as determined by the Contest Sponsor in its sole discretion), only the first Request will be considered valid.  Contest Sponsor will return by regular mail one (1) randomly selected unique PIN for contest entry, while supplies last.  To be eligible, each Request must: (i) be mailed in a separate sealed envelope bearing sufficient postage (i.e. multiple Requests in the same envelope will be void); and (ii) be postmarked during the Contest Period and received on or before November 17, 2014 to allow Contest Sponsor time to mail back the PIN via regular mail.

(d) TO ENTER ONCE PIN OBTAINED: Once an entrant has a valid PIN in accordance with these Contest rules, he/she can enter the contest via www.canadadry.ca or through the contest tab on the Canada Dry Canada Facebook page at www.facebook.com/CanadaDryCanada. 

Entrants who enter through the Canada Dry Canada Facebook page will be required to “Like” the Canada Dry Canada page prior to entering the Contest (Note: This is only required if you are not already a fan of the Canada Dry Canada Facebook page).

To enter, complete the online entry form in full following all online instructions and enter one (1) valid PIN that has been obtained in accordance with these Contest rules. Each time a participant successfully initiates a contest entry and submits a unique PIN, he/she is automatically eligible to win a Daily Prize and receives one (1) entry into the Grand Prize draw. 

BONUS ENTRIES: Entrant will receive five (5) bonus entries into the Grand Prize draw (for his/her applicable Region) if he/she uploads a photo of his/her family into the contest website; and provided that the photo meets all of the creative/technical requirements as outlined below. Entrants from Quebec can upload their photo to a picture frame/border treatment with the Les Parent logo.  Entrants from the remainder of Canada will be given the option to i) upload a single photo onto a Modern Family frame, referred to as “My Real Modern Family”; or ii) upload two (2) photos to replicate the “frame in frame” visual from the opening sequence of the Modern Family television show.  No additional bonus entries will be received for uploading two (2) photos as provided for in option (ii) herein.   

Photo Submission - Creative/Technical Requirements

Creative Requirements: Entrant must submit a photo of his/her family (the “Photo Submission”) according to the following guidelines:

Each Photo Submission must be original to the entrant and entrant has all necessary rights (including, consent of the other people in the Photo Submission).  Photo Submission must not contain any personal information of any of the members; and

Photo Submission must not have been submitted in any other competition or previously published. Modifying, enhancing or altering a third party’s pre-existing work does not qualify as entrant’s original creation.

 

Uploading/Formatting: be in electronic format (.jpg or .png) and a maximum of 2MB or smaller.

Photo Submission – General Guidelines

Photo Submission cannot promote any activities that may appear unsafe or dangerous;

Photo Submission cannot defame, misrepresent or contain disparaging remarks about any person or entity, including but not limited to the Contest Sponsor or its affiliates, as determined in the sole discretion of the Contest Sponsor;

Photo Submission cannot contain any material that may, in the sole discretion of the Contest Sponsor, infringe on the intellectual property rights of any third party, including but not limited to, copyrights or trademarks owned by others. Entrant must use his/her own original material in the creation of the Photo Submission. If a Photo Submission contains any third party material, Contest Sponsor may in its sole discretion, disqualify the Photo Submission and no bonus entries will be received. In the alternative, Contest Sponsor may ask entrant to provide the appropriate legal documentation that demonstrates (to Contest Sponsor’s satisfaction) that he/she has received proper permission to use such material for all purposes related to this Contest and for the promotion of the Contest Sponsor and its products and services, with a right to further grant and transfer such permission to Contest Sponsor and its affiliates. Failure to provide appropriate legal documentation, as determined in Contest Sponsor’s sole discretion, may result in disqualification of the Photo Submission in the sole discretion of Contest Sponsor and without notice to entrant.

Photo Submission cannot contain, advertise or promote any brand or product of any kind (other than Canada Dry or C'plus); 

Photo Submission cannot contain materials embodying the names, likeness, or other indicia of, or identifying any person, living or dead, unless appropriate permission and releases have been obtained for use of such material in the  Photo Submission;

Photo Submission cannot contain material that is unlawful, in violation of or contrary to the laws or regulations in any province or territory where the Photo Submission was taken/created;

Photo Submission may include Canada Dry or C'plus content and products; and 

Photo Submission must not contain obscene or pornographic material, defamatory or libelous statements, endorse any form of hate or hate group, invade privacy rights, exploit individuals or in any other way violate applicable laws and regulations.

Contest Sponsor reserves the right to disqualify any Photo Submission for any reason, in its sole and absolute discretion, including the determination in its sole discretion that the Photo Submission fails to satisfy any of the above guidelines, or is inconsistent with the goals, image, or policies of the Contest Sponsor. Contest Sponsor further reserves the right, in its sole and absolute discretion, to edit (or to require the entrant to edit and resubmit) any Photo Submission that contains material that violates these Contest Rules.  If your Photo Submission is approved, it will appear in the online photo gallery within approximately two (2) business days after submission.

Limit one (1) Photo Submission per entrant per day during the Contest Period. “Day” is defined as commencing at 12:00:00 am ET and ending at 11:59:59 pm ET, except for the first day of Contest where the day commences at 12:00:00 pm ET and the last day of the Contest where the day ends at 11:59:59 am ET. 

Entrants may use only one (1) Facebook account or one (1) e-mail address to enter. If it is discovered by the Contest Sponsor (using any evidence or other information made available to or otherwise discovered by the Contest Sponsor) that any person has attempted to: (i) use multiple names, identities, social media or other accounts, email addresses and/or any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or disrupt this contest; (ii) falsely enter a PIN without obtaining a PIN in accordance with these Contest rules; (iii) re-enter a PIN a subsequent time after its first use; and/or (iv) enter a PIN that has been falsified, manipulated or otherwise altered in any way (all as determined by Contest Sponsor in its sole and absolute discretion); then he/she may be disqualified from the contest in the sole and absolute discretion of the Contest Sponsor.  Any entry may be rejected if (in the sole and absolute discretion of the Contest Sponsor) the Entry Form is not fully completed with all required information (including providing a unique PIN) and submitted and received during the Contest Period.  

You may enter the Contest as often as you like, as long as each entry is made with a new and unique PIN legitimately obtained in accordance with these Contest rules. Potential winners may be required to submit their original product cap, carton, PIN card and/or original PIN reply letter (for a no purchase entry Request) with PIN matching their winning contest entry in order to be awarded a prize. Each PIN is unique and can only be used one (1) time in this Contest.  Each PIN will automatically expire after its first use or on December 1, 2014 at 11:59:59 am ET (whichever occurs first).  Each PIN submitted is subject to verification in the sole and absolute discretion of the Contest Sponsor.  Any PIN that cannot be verified to the complete satisfaction of the Contest Sponsor, in its sole and absolute discretion, is subject to immediate disqualification (in which case the entry will be declared null and void and any rights to any prize associated with such PIN will be forfeited in their entirety).  Proof of transmission (screenshots or captures etc.) or attempted transmission or of an entry or of an attempted entry of any communication, does not constitute proof of delivery or receipt by the Contest Computer.

The Contest Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Contest Sponsor – including, without limitation, government issued photo identification): (i) for the purposes of verifying an individual’s eligibility to participate in this Contest; (ii) for the purposes of verifying the eligibility and/or legitimacy of an entry or PIN entered (or purportedly entered) for the purposes of this Contest; and/or (iii) for any other reason the Contest Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with these Contest rules.  Failure to provide such proof to the complete satisfaction of the Contest Sponsor within the timeline specified by the Contest Sponsor (including, if required, providing the original PIN) may result in disqualification in the sole and absolute discretion of the Contest Sponsor.  

By entering this contest, entrants agree to be bound by these Contest rules and the decisions of the Contest Sponsor and contest judges with regards to all aspects of this Contest, which are final and binding (without right of appeal).   

 

4. PRIZES

There are a total of three thousand six hundred (3,600) daily prizes (the “Daily Prize(s)”) available to be won, as more specifically described below.

The number of Daily Prizes available to be won will diminish as prizes are awarded during the Contest Period.

Odds of winning a Daily Prize depend on the number and timing of eligible entries submitted and received in accordance with these Contest rules.

Limit of ten (10) Daily Prizes per person during the Contest Period. Should an entrant win the maximum number of Daily Prizes as specified herein, subsequent PINs submitted by that entrant will be eligible for the Grand Prize draw only.

(b) Grand Prizes:

There are two (2) Grand Prize Trip Packages available to be won (each, a “Grand Prize”). For the purposes of awarding the Grand Prizes, there will be two (2) regions (each a “Region”) as follows: (i) Region One: British Columbia, Alberta, Saskatchewan, Manitoba, Yukon, Northwest Territories, Nunavut, Ontario, Nova Scotia, New Brunswick, Newfoundland and Labrador and Prince Edward Island, and (ii) Region Two: Quebec.  For the avoidance of any doubt, there will be only one (1) Grand Prize available to be won per Region.  Once received, eligible entries will automatically be included in the applicable Region by the Contest Sponsor based on its official records based on the entrant’s Province/Territory of Residence.

The Region One Grand Prize consists of:

a trip to Los Angeles, California for the confirmed winner and up to four (4) additional guests, including: return economy class airfare for up to five (5) people departing from the major Canadian airport nearest the winner’s home (as selected by the Contest Sponsor in its sole and absolute discretion);

six (6) nights’ accommodation in two (2) standard rooms (one double occupancy, one triple occupancy) in a hotel to be selected by the Contest Sponsor at its sole discretion;

$4,000 CDN (payable via cheque) spending money;

A closed set tour of the Modern Family production set located at the Fox production facility in Los Angeles, California (set tour duration is currently estimated to last a minimum of one (1) hour); and

 

up to five (5) passes to attend a Modern Family actors’ table script reading with a minimum of three (3) Modern Family cast members.

Approximate retail value of the Region One Grand Prize may vary depending on the point of departure. Sample value based on a St. John’s, NFLD departure is $20,000 CDN.   No difference between the actual and approximate retail values will be awarded. Choice of flights, airline(s), hotel accommodations (including, without limitation, room size and occupancy) are at the sole and absolute discretion of the Contest Sponsor.  

 

The Region One Grand Prize must be taken between January 5 and March 1, 2015 (subject to confirmation or change), except during statutory or Fox Studios corporate holidays and/or blackout periods. 

The Region Two Grand Prize consists of:

a trip to Los Angeles, California for the confirmed winner and up to four (4) additional guests, including: return economy class airfare for up to five (5) people  departing from the major Canadian airport nearest the winner’s home (as selected by the Contest Sponsor in its sole and absolute discretion);

six (6) nights’ accommodation in two (2) standard rooms (one double occupancy, one triple occupancy) in a hotel to be selected by the Contest Sponsor at its sole discretion;

$4,000 CDN (payable via cheque) spending money; and 

a “Les Parent Experience” at the Montreal studio location, including passes for the winner and up to four (4) additional guests to receive a one (1) hour meet and greet with Les Parent cast members and a private tour of the production set.

Approximate retail value of the Region Two Grand Prize may vary depending on the point of departure. Sample value based on a Montreal, Quebec departure is $20,000 CDN.   No difference between the actual and approximate retail values will be awarded. Choice of flights, airline(s), hotel accommodations (including, without limitation, room size and occupancy) are at the sole and absolute discretion of the Contest Sponsor.  

 

The Los Angeles, California portion of the Region Two Grand Prize must be taken between January 5 and March 1, 2015 (subject to confirmation or change) except during statutory holidays and/or any blackout periods.

The Les Parent portion of the Region Two Grand Prize must be taken between February 1 and June 30, 2015 (subject to confirmation or change) except for statutory, broadcaster corporate holidays and/or blackout periods. 

All travel dates as noted above for both Grand Prizes are subject to confirmation or change, at the sole and absolute discretion of the Contest Sponsor.

Odds of being selected as a potential Grand Prize winner depend on the total number of eligible entries submitted and received in accordance with these Contest rules per Region during the Contest Period. 

The Contest Parties, Facebook Inc., Fox Entertainment Group, Inc., Radio Canada, Attraction Images Productions II Inc., Electrolux Canada, iRobot Corporation, Sony of Canada Ltd., MyAxs Inc. participating retailers and each of their respective officers, directors, employees, agents, representatives, successors and assigns (collectively, the “Released Parties”) do not assume responsibility should any portion of the Grand Prizes  be cancelled, delayed or suspended. 

All prizes must be accepted as awarded and may not be transferred, exchanged, assigned or refunded. The Contest Sponsor reserves the right, in its sole discretion, to substitute any prize or a portion thereof with a prize or prizes of at least equal value (including, without limitation, at the sole and absolute discretion of the Contest Sponsor, a cash award), in the event of the unavailability, for whatever reason, of the advertised prize(s) or any portion thereof. For greater certainty, there is no monetary value ascribed to the opportunity to attend any of set tours, meet and greet and table script readings.

Shipped prizes shall not be insured and the Released Parties shall not assume any liability for lost, damaged or misdirected prizes. Any setup, assembly or installation required for a Prize will be at the winner's sole responsibility and expense. It is anticipated that Daily Prizes will be delivered to confirmed winners within six (6) to eight (8) weeks of confirmation.

5. METHOD OF AWARDING PRIZES

DAILY PRIZES:

During the Contest Period, three thousand six hundred (3,600) random times will be selected via a computerized randomizer program (each, a “Winning Time”). Each entry which is entered on, or most closely following, a Winning Time will initiate an onscreen message identifying the entrant as a potential winner of one of the Daily Prizes. Although the PIN does not affect the chance of winning a Prize, an entrant must enter a unique and valid PIN that has been obtained in accordance with these Contest rules each time he/she enters the Contest. 

Daily Prizes will only be awarded as noted in the on-screen notification. Any discrepancy between the Prize listed in the on-screen Prize notification or on the Declaration and Release form (where applicable), will default to the Prize listed in the Contest database.

Before being declared a winner of a Daily Prize, the potential winner must correctly answer, unaided, a mathematical skill-testing question and where applicable, complete, sign and return the Contest Sponsor’s Declaration and Release Form within ten (10) days of receipt (the “Prize Claim Date”).

Declaration and Release Forms are not required for the free product coupon. Where a Declaration and Release Form is required to be signed, a Declaration and Release Form will be available for download by the potential winner of that Daily Prize. If a potential winner of a Daily Prize is not in compliance with these Contest rules, incorrectly answers the skill-testing question, declines the Daily Prize, fails to return the required Declaration and Release Form (if applicable) by the Prize Claim Date or if email or other correspondence between the Contest Sponsor and the entrant is returned as undeliverable, the applicable Daily Prize may be forfeited by that entrant.  Unclaimed Daily Prizes will not be awarded.

GRAND PRIZE DRAWS:

On December 5, 2014 at approximately 2:00 pm ET in Markham, Ontario, two (2) Grand Prize draws will be held (one per Region) and one (1) potential Grand Prize winner will be randomly selected from all eligible entries submitted and received in accordance with these Contest rules from each Region. 

Selected Grand Prize entrants will be contacted by email and/or telephone (if a phone number was provided on the entry form) on or before December 8, 2014 with further information on how to be confirmed as a winner and claim the Grand Prize.  If a selected entrant cannot be reached, for whatever reason, by this date, another entrant may be randomly selected (from among the remaining eligible entries submitted and received in accordance with these Contest rules for such Region) at the sole and absolute discretion of the Contest Sponsor.

Before being declared a winner of a Grand Prize, each selected entrant must correctly answer, unaided, a mathematical skill-testing question and complete, sign and return a Declaration and Release Form (and any other documents, as applicable) by the Prize Claim Date.

If a potential Grand Prize winner cannot be reached/located, fails to reply within ten (10) days following contact by the Contest Sponsor's representative, is not in compliance with these Contest rules, incorrectly answers the skill-testing question, declines the Grand Prize, fails to return the Declaration and Release form (and any other documents, as applicable) by the Prize Claim Date, cannot travel on the dates designated by the Contest Sponsor, or if email or other correspondence between the Contest Sponsor and potential winner is returned as undeliverable, the Grand Prize may be forfeited by that potential winner and the Contest Sponsor reserves the right to randomly select another potential winner from among the remaining eligible entries submitted and received in accordance with these Contest rules for such Region.

All Prizes will be awarded, subject to these Contest rules, upon receipt of the properly completed and executed Declaration and Release Form, where applicable, and verification of Prize winner.

6. GENERAL

For each Grand Prize, bookings are subject to availability, changes in itinerary and other restrictions. Blackout dates may apply.  At the time of booking, winner must provide valid travel documents for both himself/herself and his/her travelling companions. Bookings are also subject to all rules and regulations of the applicable airline or other carrier. Trip must be booked through Contest Sponsor’s promotional agency. Trip cannot be modified by winner. All bookings are subject to existing availability and are subject to change at the sole discretion of the Contest Sponsor. The Contest Sponsor shall have no responsibility for trip cancellations, alterations, weather delays, weather cancellations or other changes to the trip itinerary and by accepting the Grand Prize, the winner acknowledges and accepts such risks. The Grand Prize winner and his/her guests will be responsible for all costs and expenses not specifically stated above as included in the Grand Prize including, but not limited to, side trips, ground transportation (other than what has been outlined in the Grand Prize description), travel and health insurance, personal expenses, medical expenses, meals, beverages, gratuities, gift shop purchases, phone calls and all other expenses and travel requirements not specifically described above as being included in the Grand Prize. The Grand Prize winner may be required by the airline or hotel to provide an accepted and valid credit card to cover incidental charges (including but not limited to: telephone charges, special purchases, etc.). The Grand Prize winner and his/her travelling companions must travel on the same itinerary and must each have valid travel documents and identification. Necessary travel documents are solely the responsibility of the winner and his/her travelling companions. In order to be entitled to accompany the winner, the winner’s guests must sign (and have his/her parent/legal guardian sign if he/she is under the legal age of majority in his/her jurisdiction of residence) and return a Declaration and Release Form (and any other documents reasonably required by the Contest Sponsor) by the timeframe indicated on the form.  The Released Parties are not responsible in the event winner and/or travel companion are refused entry into destination city or country or re-entry into their Province or Territory of residence for whatever reason. The Released Parties do not assume responsibility should any portion of the Grand Prize trip be cancelled, delayed, suspended or rescheduled for any reason beyond its control. If, for any reason, an event included as part of the Grand Prize does not occur, that portion of the Grand Prize will be forfeited without additional compensation and the remainder of the Grand Prize will be awarded.

7. The approximate retail values of prizes as stated by the Contest Sponsor in point of sale advertising, and other advertising, promotion materials, and/or in these Contest rules are subject to price fluctuations in the consumer marketplace based on, among other things, the passage of time between the date the approximate retail values are stated by the Contest Sponsor and the date the prizes are awarded or redeemed. If, at the time a prize is redeemed or awarded, the actual prevailing retail purchase price for the prize is less than the approximate retail value stated by the Contest Sponsor in point of sale, television and print advertising, promotion materials, and/or in these Contest rules, the prize winner will not be entitled to a cheque or cash for the price difference.

8.  GRANT OF RIGHTS TO CONTEST SPONSOR:  By entering a Photo Submission into the Contest, the applicable entrant represents and warrants to the Contest Sponsor that such Photo Submission is wholly original to the entrant and that he/she owns all right, title and interest in and to the Photo Submission.  Without further compensation, the entrant agrees that: 

the entrant on behalf of him/herself, his/her heirs, executors, administrators and assigns, grants to the Contest Sponsor an exclusive, perpetual, royalty-free, worldwide license and right to broadcast, exhibit and/or otherwise use the Photo Submission (and the entrant’s entry) and every element thereof, in whole or in part, in any manner or medium now or hereafter known or devised and, without limiting the foregoing, but for greater certainty, expressly grants to the Contest Sponsor the license and right to post, publish and/or otherwise display the Photo Submission on or via the website. All decisions regarding such use shall be at Contest Sponsor’s sole and absolute discretion. All Photo Submissions, upon submission, becomes the property of Contest Sponsor, and its successors, assigns and licensees. Contest Sponsor will have the exclusive right to make unlimited derivative works therefrom, to assign or transfer any or all such rights and to grant unlimited sublicenses. Entrant forever waives and relinquishes on behalf of themselves, their heirs, executors, administrators and assigns any and all rights, including but not limited to goodwill, in and to the Photo Submission; 

he/she shall have no right of approval or consultation with respect to Contest Sponsor's use of the Photo Submission. Contest Sponsor will not be responsible for the return or preservation of the Photo Submission. Contest Sponsor shall use its sole discretion in determining the extent and manner of the use of the Photo Submission;

the Contest Sponsor shall have the unconditional and perpetual right and permission to reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, exhibit and/or otherwise use or reuse (without limitation as to when or to the number of times used), the entrant's name, address, image, voice, likeness, statements, biographical material and entry, as well as any additional photographic images, video images, portraits, interviews or other materials relating to the entrant and arising out of his/her participation in this Contest (with or without using the entrant's name) in any media throughout the world for any purpose, without limitation, and without additional review, compensation, or approval from the entrant or any other party; 

the entrant further represents that he/she has not granted or transferred any rights in or to the Photo Submission to any third party prior to the date of entry into the Contest and has not done anything and will not do anything to impair the rights granted to the Contest Sponsor in any way; and

e. where applicable, the entrant grants to Fox Entertainment Group, Inc. (“Fox”) an exclusive, perpetual, irrevocable license to use the image for any purpose and in any manner Fox chooses.  This license is effective as of the date entrant submits his/her Photo Submission into the contest.  This license may be transferred and/or sub-licensed by Fox. This license does not obligate Fox to use the image.

9. The decisions of the Contest Sponsor and/or the judges are final and binding, without right of appeal, with respect to all aspects of this contest (including without limitation eligibility and/or disqualification of entries and PINs) and entrant agrees to abide by the Contest rules and all of the instructions and decisions of the Contest Sponsor and/or judges. In the event of any dispute regarding the interpretation of these Contest rules, the decision or interpretation of the Contest Sponsor and/or judges shall prevail.

10. Unless otherwise deemed appropriate by the Contest Sponsor for the administration of the contest based on the circumstances, no communications will be entered into except with selected entrants. Once Grand Prize winners have been verified and confirmed, the Grand Prize winners' names will be posted at  HYPERLINK "http://www.canadadry.ca" www.canadadry.ca and/or at  HYPERLINK "http://www.facebook.com/CanadaDryCanada" www.facebook.com/CanadaDryCanada contest page. 11. All entries become the property of the Contest Sponsor. Any entry that is late, incomplete, altered, or contains false information, is invalid. The Released Parties are not responsible for lost, stolen, delayed, damaged or misdirected claims or entries or for any problems or technical malfunction of any Internet or telephone network or broadcast transmission during the Contest Period. The Released Parties are not responsible for any errors or omissions with respect to the printing or advertising of this contest and reserves the right, subject only to the approval of the Régie des alcools, des courses et des jeux (the “Régie”) in Quebec, to withdraw, amend or cancel this contest in the event of a printing or administrative error.

12. In the event, due to a printing, manufacturing, mechanical or other error, more prizes are claimed than are intended to be awarded according to these Contest rules, prizes will stop being awarded when the Contest Sponsor becomes aware of an error respecting the number of prizes and the Contest Sponsor reserves the right, in its sole and absolute discretion, to conduct a random draw from amongst all eligible and approved prize claimants whose claims have not yet been redeemed to award the remaining number of advertised prizes. In no event will the Released Parties be liable for more than the stated number of prizes contained in these official Contest rules.

13. The Released Parties accept no responsibility for loss, damage or claims caused by the awarded prizes or the contest itself. By entering, entrant releases and holds harmless the Released Parties from any and all liability for any injuries, loss or damage of any kind arising from or in connection with the contest or any prize (or a portion thereof) won or with respect to the photographs, video, audio taken and/or their use.

14. Without limiting the release of liability provisions herein, and for greater certainty, the Released Parties will not be liable for: a) any incorrect or inaccurate information, whether caused by contest website users or by any equipment or programming associated with or utilized in the contest or by any technical or human error which may occur in the processing of entries in the contest; b) any error, omission, interruption, deletion, defect or delay in operation of the contest website or any transmission in connection with the contest; c) any communications line failure, theft, destruction or unauthorized access to, or alteration of, entries; d) any problems with, or technical malfunction of, any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, or failure of email which may occur for any reason whatsoever, including technical problems or traffic congestion on the Internet or at any website or combination thereof; or e) any injury or damage to entrants' or to any other person's computer or other device related to or resulting from participating or downloading materials in this contest. If the contest is not capable of running as planned for any reason, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause of any nature whatsoever beyond the reasonable control of the Released Parties which corrupt or affect the administration, security or proper conduct of this contest, the Contest Sponsor reserves the right at its sole discretion to, without advance notice, terminate or suspend the contest, in whole or in part, or modify it in any way, subject only to the approval of the Régie in respect of residents of Quebec (where applicable).

15. In the event of a dispute as to who submitted an email entry, the Contest Sponsor reserves the right, in its sole and absolute discretion, to deem the entry to have been submitted by the authorized account holder of the email address submitted at the time of entry. "Authorized Account Holder" is defined as the natural person who is assigned to an email address by an Internet access provider, on-line service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Entrant may be required to provide the Contest Sponsor with proof that he/she is the authorized account holder of the email address associated with the entry.

16. The Contest Sponsor reserves the right at its sole discretion to disqualify any individual from the contest, and to ban that individual from any future promotion of the Contest Sponsor, if the Contest Sponsor finds or believes such individual to be tampering with the entry process or the operation of the contest or where applicable, the contest website; to be acting in violation of the Contest rules or in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass the Contest Sponsor, the Contest Sponsor's agencies, other entrants or any other person. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER PERSON TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE CONTEST SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

17. By entering this contest, you consent to the Contest Sponsor's use, should you become a winner, of your name, place of residence and photograph or other likeness, without further compensation or notice, for publicity, advertising (including via canadadry.ca) or informational purposes in any media or format (including the Internet) in connection with this contest. 

18. The Contest Sponsor is collecting personal data about the entrants for the purpose of administering this contest. No further informational or marketing communications will be received by entrants, unless the entrant has specifically opted-in to receive such communications. The Contest Sponsor respects your right to privacy of your personal information. Please review our Privacy Policy for details on the manner in which we collect, use, disclose, and otherwise manage your personal information.

19. Except as provided in Rule 21, this contest is subject to all applicable laws and shall be governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein.

20. The invalidity or unenforceability of any provision of these Contest rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Contest rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

21. For residents of Quebec, any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie for a ruling. Any litigation respecting the awarding of a Prize may be submitted to the board only for the purpose of helping the parties reach a settlement. 

22. The contest is in no way sponsored, endorsed or administered by, or associated with Facebook. You understand that you are providing your information to the Contest Sponsor and not to Facebook. The information you provide will only be used for the administration of this Contest and in accordance with the Contest Sponsor's Privacy Policy. Facebook is completely released of all liability by each entrant in this Contest. Any questions, comments or complaints regarding the contest must be directed to the Contest Sponsor and not Facebook.

23.  The Contest Sponsor reserves the right, subject only to the approval of the Régie in Quebec, to adjust any of the dates, timeframes and/or other contest mechanics stipulated in these Contest rules, to the extent necessary, for purposes of verifying compliance by any entrant or entry with these Contest rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Contest Sponsor, in its sole and absolute discretion, affect the proper administration of the contest as contemplated in these Contest rules, or for any other reason.

24.  In the event of any discrepancy or inconsistency between the terms and conditions of these English Rules and disclosures or other statements contained in any Contest-related materials, the terms and conditions of these English Rules shall prevail, govern and control to the fullest extent permitted by law.
